Please read carefully the foregoing Terms and Conditions of Use (“TCU”) of www.odessadarlings.com website and the related Privacy Policy Statement  These TCU sets forth the standards of use of our website.  By clicking the agree button you confirm and agree to these terms and conditions as stated herein. OdessaDarlings.com reserves the right at any time to change/modify or alter or update the terms and conditions of use without notice. By your registration, you take sole responsibility for the materials or information you display on your profile or transmit to other members of the site.

You further agree that as a registered member of www.odessadarlings.com, you will not use the site or its services to:

2. Upload, post, e-mail, or otherwise transmit or post links to any personal profile information such as telephone numbers, street addresses, last names, URLs, e-mail addresses, offensive anatomical or sexual references, or offensive sexually suggestive or connotative language, or any confidential information of any third person;
3. Collect or store personally identifying information about other users for commercial or unlawful purposes;
4. Upload, post, e-mail, otherwise transmit, or post links to any Content, or select any member or user name or e-mail address, that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, pornographic, libelous, invasive of private or public rights,  hateful, or racially, sexually, ethnically or otherwise objectionable;
5. Upload, post e-mail or otherwise transmit or post links to any photographs or other images containing nudity or such personal information.   OdessaDarlings.com reserves the right, but has the obligation, to reject any profile or photograph or image that does not comply with these prohibitions;
6. Impersonate any person or entity;
7. Use the website for your personal and exclusive use;
8. Give only truthful responses to the questions asked in the online membership Sign Up Registration Form;
9. Attempt to solicit or soliciting any money from any member of OdessaDarlings.com is prohibited and any one found or reported will be barred from the use of the site and will be tag as SCAMMER;
10. Harass any person by continuing to attempt to communicate with someone who has clearly asked you to stop any form of communications;
11. Engage in advertising to, or solicitation of, other Members to buy or sell any products or services through the Service;
12. Upload, post, e-mail otherwise transmit, or post links to any unsolicited or unauthorized advertising, promotional materials, “junk mail”, “spam”, “chain letters”, “pyramid scheme”, or any other form of solicitation, except in those areas that are designated for such purpose;
13. Express or imply that any statements you make are endorsed by us, without our specific prior written consent;
14. Upload, post, e-mail, otherwise transmits or post links to any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment or to diminish the quality of, interfere with the performance of, or impair the functionality of the Products and Services of OdessaDarlings.com.
15. Employ misleading e-mail addresses or falsify information in the header, footer, return path, or any part of any communication, including e-mails, transmitted through the Services.
16. “Frame” or “mirror” any part of the Site without prior written authorization.  You also shall not use metatags or code or other devices containing any reference to Odessadarlings.com or the Service of the site in order to direct any other website for any purpose.
17. You are solely responsible for your interactions with other members. You are responsible for you own privacy and any information you make available through this site.
18. You are aware that this site is not responsible for the online conversations expressed by the users of this site and does not necessarily agree with any content posted on this site.

Moreover any violation by any member of the online conduct set forth herein allows odessadarlings.com to remove or discontinue site membership.

III. Message Modification or Deletion

As a registered member you understand that www.odessadarlings.com does not screen or monitor all messages sent through their messaging system.  However OdessaDarlings.com reserves the right to modify or delete messages that are judged to be inappropriate, offensive, obscene, profane, slanderous, threatening, harassing, racially offensive or illegal, attempt to solicit money from any members or those with unauthorized commercial content.

V. Liability Limitations

OdessaDarlings.com is a membership at will and as such is not liable to the members/users of their services or to their registered members for the content, quality, performance or any other aspect of information provided by their users and members and transmitted by the use of this site’s service.
2. OdessaDarlings.com is not responsible for any damage to any person, arising in any manner out of the use of this service.   Member assumes all risk and or responsibility for any loss or damage arising from the use of the site.
3. OdessaDarlings.com does not monitor or control the use of its site by the member.  As such it is the member’s sole responsibility for the legality of your actions under all applicable laws and that odessadarlings.com is free from any liability for the actions of any of its members.
4. OdessaDarlings.com does not warrant the risks of dealing with internet users, particularly those that are based in other countries, underage persons under false pretence or those with criminal intent. 
5. OdessaDarlings.com made it clear that user authentication on the internet is extremely difficult and accordingly can not and does not confirm that a particular member or user is who he or she claims to be.  Therefore all members are advised to be extremely careful in dealing with OdessaDarlings.com website.

VI. Conditions of Warranty
 
OdessaDarlings.com provides the service on an “as is” basis and gives no warranties of any kind with respect to the service provided by the site.  It also does not guarantee that the use of the site will be fully secured, uninterrupted and always available or error-free.

VII. Indemnity and Waiver of Rights

As a OdessaDarlings.com member I declare the company together with its officers and employees harmless and free from and against any claims, liabilities, losses, costs, damages or expenses including but not limited to all legal costs and legal fees arising from the member’s use or participation in this site or of the information contained thereof.

By joining the site, I have waived all my rights to:
C. All photos/pictures, materials and writings and other information I voluntarily submitted to www.odessadarlings.com site as a consequence of my membership;
D. Modify and/or delete a portion or all of my profiles that are considered to be inappropriate or for any other reasons deem proper and legal;
E. Use my public information together with the photo/s and post it in my members’ profile gallery available for search.

Furthermore, I give full permission and released www.odessadarlings.com of any liability should there be any, in the use of my pictures/photos and other materials for promotional purpose, including but not limited to business and marketing campaign ad.

I further understand that should I decide to discontinue my membership with www.odessadarlings.com for any reason at all, I only have the option to TURN OFF my profile or request to be turned off.  However, www.odessadarlings.com is under no obligation to completely delete my record from their database for whatever legal purpose it may serve the company best.

I attest to the best of my ability that the above conditions are clear to me and I waive my right of recourse against www.odessadarlings.com for any damage, direct or indirect, incidental or consequential that I may suffer as a result of the use of the materials I voluntary submitted.

VIII. General Provisions

I, of legal enter into this membership agreement with odessadarlings.com in my own free and voluntary act and deed.  And I accept the TERMS AND CONDITIONS OF USE of the site without reservation. With my acceptance, I am obliged to abide by the site’s policies in place or such other changes in the future. Should any provisions of this Agreement becomes invalid or declared no longer effective, the remainder of this Agreement shall continue to be in full force and effect unless revised or revoked.  Amendments if any shall be posted in the site and becomes effective upon posting.
